As expected, today the government did appeal to the D.C. Circuit Judge Friedman's decision to deny its motion for a stay pending the merits appeal of Almerfedi v. Obama. The government wrote in its emergency motion for stay pending appeal that the district court's decision was error.

As expected, today the government did appeal to the D.C. Circuit Judge Friedman's decision to deny its motion for a stay pending the merits appeal of Almerfedi v. Obama. The government wrote in its emergency motion for stay pending appeal that the district court's decision was error. In addition to presenting arguments about why it is entitled to a stay while the merits appeal moves forward, the government also asked for a temporary stay of the district court's release order.

Larkin Reynolds is an associate at a D.C. law firm and was a legal fellow at Brookings from 2010 to 2011. Larkin holds a J.D. from Harvard Law School, where she served as a founding editor of the Harvard National Security Journal and interned with the Senate Judiciary Committee, the Navy Judge Advocate General’s Corps, and the National Security Division of the Department of Justice.
