2018 Case Supplement for ‘Computer Crime Law, 4th Edition’

As some readers know, I wrote a law school casebook on computer crime law. The first edition came out in 2006, and it has been updated over time: The fourth edition came out in January 2018. As some readers know, I wrote a law school casebook on computer crime law. The first edition came out in 2006, and it has been updated over time: The fourth edition came out in January 2018. If you’re interested in checking out the casebook, its first 40 pages—which includes the introduction, the table of contents and the first 30 pages of text—is available for download here on SSRN.

I wanted to flag that I recently posted a new case supplement for the casebook to update the casebook. I have typically made supplements year to year. But with so many developments in the field over the past six months, I decided a midyear supplement was necessary. The supplement includes coverage of Carpenter, the Cloud Act, new cases on the border search exception, the Computer Fraud and Abuse Act, the Stored Communications Act, and more.

I realize that only a small set of Lawfare readers will be interested in a law school casebook. But a wider array of readers might find the new supplement useful, as it tries to summarize legal developments in addition to presenting the raw new materials and asking the usual annoyingly unanswerable academic questions about them.

Orin Kerr is a Professor at the University of California, Berkeley School of Law. He is a nationally recognized scholar of criminal procedure and computer crime law. Before becoming a law professor, Kerr was a trial attorney in the Computer Crime and Intellectual Property Section at the Department of Justice and a Special Assistant U.S. Attorney in the Eastern District of Virginia. He is a former law clerk for Justice Anthony M. Kennedy of the U.S. Supreme Court and Judge Leonard I. Garth of the U.S. Court of Appeals for the Third Circuit.
