FBI Publishes FISA Query Guidance From 2021

The Bureau released to the public two internal documents distributed in 2021 outlining procedures for the query of FISA information.

On April 24, the FBI released two documents that give guidance for FBI employees’ querying of information obtained pursuant to section 702 of the Foreign Intelligence Surveillance Act (FISA). FISA governs the collection of foreign intelligence information on U.S. soil.

The guidance, released internally in November 2021, was released this week “in the interest of transparency and to further inform the public about FISA and how the FBI uses it,” according to the FBI’s statement accompanying the documents’ release. The guidance in 2021 followed a report by the Justice Department’s Inspector General that found widespread issues with the FBI’s handling of FISA applications.
