On Feb. 21, Judge George B. Daniels of the Southern District of New York issued a 30-page opinion denying an attempt by families of the victims of Sept. 11 to gain access to $3.5 billion in frozen assets from Da Afghanistan Bank, which are currently held at the Federal Reserve Bank of New York.
Daniels adopted the magistrate's finding that the court lacked subject-matter jurisdiction and was "constitutionally restrained from determining the Taliban is the legitimate government of Afghanistan as required to attach DAB's assets."
