Two weeks ago, on the podcast, we ran a speech on encryption that FBI Director James Comey gave at the Brookings Institution and the resulting discussion with a very engaged audience. One person in that audience, the one who asked the first question, was ACLU technologist and cybersecurity expert Chris Soghoian. Chris has long been a sparring partner of mine on surveillance issues, and he had been critical of Lawfare for not having a technologist on the dais with Comey. So I invited him over to Brookings to respond to Comey. What exactly are his objections to Comey's proposal for preserving the ability to decrypt communications and stored data with a warrant? And how afraid is he about a world in which smartphone data can't be accessed?
