The Lawfare Podcast: Todd Huntley and Marc Garlasco on the Pentagon's New CIVCAS Action Plan

On August 25, the Defense Department released its long-awaited Civilian Harm Mitigation and Response Action Plan, something that human rights advocates have called on the Pentagon to do for the past 20 years. To discuss it, former Lawfare associate editor Tia Sewell sat down with Todd Huntley, a former JAG and current director of the National Security Law Program at Georgetown University Law Center, as well as Marc Garlasco, a former targeting professional and war crimes investigator who consulted on the plan. They talked about Todd’s and Marc’s respective Lawfare articles on the topic and how this new action plan improves the Pentagon's handling of civilian harm in war or not.


Jen Patja is the editor and producer of the Lawfare Podcast and Rational Security. She currently serves as the Co-Executive Director of Virginia Civics, a nonprofit organization that empowers the next generation of leaders in Virginia by promoting constitutional literacy, critical thinking, and civic engagement. She is the former Deputy Director of the Robert H. Smith Center for the Constitution at James Madison's Montpelier and has been a freelance editor for over 20 years.
Tia Sewell is a former associate editor of Lawfare. She studied international relations and economics at Stanford University and is now a master’s student in international security at Sciences Po in Paris.
Todd Huntley is the Director of the National Security Law Program at Georgetown University Law Center and a Lecturer in Law, teaching National Security Law related courses. Todd retired from the U.S. Navy in September 2020 after serving more than 23 years on active duty as a Judge Advocate General where he advised senior military and civilian leaders on national security and international law matters. He has extensive experience supporting the Special Operations community, including serving as the senior U.S. Special Operations Command (SOCOM) attorney in Washington, D.C.; the senior legal advisor to the Commander, U.S. Special Operations Command Central (SOCCENT); and as the legal advisor for information and cyber operations at SOCOM HQ in Tampa, FL. Todd has deployed twice to Afghanistan with a Joint Special Operations Task Force conducting counter-terrorism operations and has advised on all aspects of operations including targeting, intelligence, detention, and cyber operations.
Marc Garlasco is the military advisor at PAX and a consultant for the Pentagon's Civilian Harm Mitigation and Response Action Plan. He is also a trainer at the Institute for International Criminal Investigations where he is currently training Ukrainian war crimes teams.
