I was unaware when I wrote my post this morning that my frequent sparring partner Steve Vladeck had given testimony on the Espionage Act and related statutes this past spring. It is an excellent primer on the subject. Reading it over, I find myself in the uncharacteristic position of not merely admiring Steve's work (which I always do) but of agreeing with virtually every word of it (which I almost never do). I commend it to anyone interested in the possibility of prosecuting Assange or Wikileaks or the design of laws that might plausibly enable such prosecutions without endangering cherished values.
